General Terms and Conditions

Terms and Conditions was last updated on 26 March 2024 and applies to citizens and persons with permanent residence in the European Economic Area and Switzerland.

Scope of application

These General Terms and Conditions apply between

a non-profit organisation under Swiss law (hereinafter: “House of Happiness”) and natural or legal persons who make donations via the website www.houseofhappiness.ch (hereinafter: “Donors”).

  1. The GTC apply in the version valid at the time of the transfer of the donation.
  2. The General Terms and Conditions of “House of Happiness” apply exclusively. Donors expressly recognise the General Terms and Conditions by transferring a donation. Donors’ terms and conditions that contradict or deviate from the House of Happiness terms and conditions will not be recognised unless House of Happiness has expressly agreed to them in writing in individual cases.
  3. “House of Happiness reserves the right to amend these GTC at any time.

Object and conclusion of contract

  1. Donors make a one-off donation to “House of Happiness” of the amount selected or entered by them in the input mask.
  2. The contract relating to the donation is concluded when it is transferred.

Use of the donations

  1. The “House of Happiness” association is generally authorised to use the donation freely within the scope of the association’s purpose (non-earmarked donations). House of Happiness” always uses non-earmarked donations directly to support our “House of Happiness” project in Tanzania. No other conditions or requirements are attached to non-earmarked donations. The donation does not convey any entitlement to the funding of specific projects or any other rights of the donor.
  2. If donors make donations on the website www.houseofhappiness.ch with a donation subject on which a specific donation purpose is stated (e.g. donation for scholarships or donation for clothing), the Haose of Happiness association will use the donation as described on this subpage (earmarked donations). The “House of Happiness” is authorised to treat earmarked donations in the same way as non-earmarked donations if there are important and objectively justified reasons for doing so.

Means and methods of payment

“House of Happiness” accepts the following means of payment:

  • Direct transfer with Postfinance, bank or savings bank
  • Swiss payment slip (QR code)
  • TWINT

Correction of input errors

Input errors made when manually entering the donation amount must be corrected within 7 days of their discovery. The possibility of correcting input errors expires one year after the donation has been made. The correction must be sent in writing to:

Taxes and duties

  1. In accordance with current Swiss tax legislation, donations to the “House of Happiness” association can be deducted from tax in Switzerland and Liechtenstein under certain conditions. However, “House of Happiness” does not guarantee the deductibility of donations. Any lack of deductibility does not entitle the donor to revoke completed donations.
  2. Donations are confirmed by “House of Happiness” by means of a tax receipt.
  3. If, contrary to expectations, taxes or duties are incurred by the donor as a result of the donation, these are to be borne by the donor.

Data protection

  1. The data required for business transactions are stored in compliance with the applicable regulations. Further information on the handling of your data can be found in our privacy policy.
  2. Donors have the right to free information, correction, blocking and, if necessary, deletion of their stored data at any time. Please contact us by e-mail at info@houseofhappiness.ch or send us your requests by post.

Applicable law, place of jurisdiction and miscellaneous

  1. The provisions of Swiss law shall apply exclusively. The application of the conflict of laws rules is excluded.
  2. The exclusive place of jurisdiction for all claims in connection with donations is Reigoldswil.
  3. The invalidity of individual provisions shall not affect the remaining validity of these GTC.
